Apple and AT&T get sued for a phone that can barely make calls

Somehow this is rather expected from the people of United States. Just waiting for it to happen, but I did not expect it to be this fast. The lawsuit was filed by Ward & Ward, PLLC and Charles A. Gilman, LLC. on behalf of Kevin McCaffrey, Linda Wrinn and a number of other iPhone 4 users, based on the antenna issue of the new iPhone 4.
For those just back from the jungle, the iPhone was sold worldwide in a couple of countries on June 23, and soon after, thousands of users reported on the internet of the iPhone 4’s signal drop issue when their hands get in contact with the ‘unique’ antenna that is built onto the aluminum chassis’s lower band.
From what I see, Apple’s trying to get the ‘antenna on the band’ thing out to woo customers on the uniqueness of the iPhone 4. Antenna engineers would have known the possible problems occurring by designing such antenna, which is exposed to human fingers with statics. Might be Steve Jobs’s obsession towards perfection that caused such design flaw to continue into the production. It’s not possible that the engineers did not notice the issue during testing periods. Maybe they’re too stunned by the amazing Retina display that they did not even try to use the iPhone 4 to call.
Anyway, here are the lists of the claims:
• General Negligence (APPLE and AT&T)
• Defect in Design, Manufacture, and Assembly (APPLE)
• Breach of Express Warranty (APPLE)
• Breach of Implied Warranty for Merchantability (APPLE and AT&T)
• Breach of Implied Warranty of Fitness for a Particular Purpose (APPLE and AT&T)
• Deceptive Trade Practices (APPLE and AT&T)
• Intentional Misrepresentation (APPLE and AT&T)
• Negligent Misrepresentation (APPLE and AT&T)
• Fraud by Concealment (APPLE and AT&T)
